Traffic Data Group, Inc., a Delaware corporation operating under the brand name Argus AI ("Argus AI," "Company," "we," "us," or "our"), is committed to protecting the privacy and security of our users. This Privacy Policy explains how we access, collect, use, share, and protect your information when you use our mobile application ("App"), our website located at getargus.ai ("Website"), our application programming interfaces ("APIs"), and all related services (collectively, the "Services").

This Privacy Policy applies to all users of the Services, including individual drivers, fleet administrators, fleet users, and website visitors. By downloading, installing, accessing, or using any part of the Services, you acknowledge that you have read and understood this Privacy Policy and consent to the practices described herein. If you do not agree with this Privacy Policy, you must immediately cease all use of the Services and delete any installed applications.

1. Information We Collect

We collect information in three ways: information you provide directly, information collected automatically through your use of the Services, and information received from third-party sources.

1.1 Information You Provide

When you create an account, subscribe, or otherwise interact with the Services, we may collect the following categories of information directly from you:

  • Account Information. Name, email address, phone number, and account credentials. You may create an account using email and password or through Google Sign-In, in which case we receive your name, email address, and profile information from Google in accordance with Google's privacy policies.
  • Vehicle Information. Vehicle specifications including height, width, length, weight, number of axles, axle weight distribution, trailer configuration, and hazardous materials classification.
  • Payment Information. Billing details and payment method information for subscription transactions. Payment processing is handled by third-party payment processors; we do not store full credit card numbers on our servers.
  • Fleet Account Information. If you are a fleet administrator, we collect information about your organization, fleet vehicles, and fleet users that you add to your account.
  • Communications. Records of your communications with us, including support requests, feedback, and other correspondence.
  • User-Generated Content. Road condition reports, fuel price information, parking availability reports, reviews, ratings, and other content you submit through the Services.

1.2 Information Collected Automatically

When you use the Services, we automatically collect certain information from your device, including:

  • Precise Location Data. We collect your device's precise GPS location to provide navigation, routing, and real-time traffic alerts. This includes location data collected in the background when the App is closed or not in active use, in order to deliver proactive traffic and incident alerts, monitor route conditions, and provide timely notifications relevant to your trip. You will be asked to grant location permissions when you first use the App, and you may revoke background location access at any time through your device settings, though doing so will impair or prevent certain functionality of the Services.
  • Trip and Route Data. Routes traveled, trip history, navigation preferences, and driving patterns.
  • Device Information. Device type, operating system and version, unique device identifiers, hardware model, mobile network information, and App version.
  • Usage Data. App interactions, features used, screens viewed, session duration, timestamps, navigation preferences, and error logs.
  • Log Data. IP address, browser type (for Website access), access times, referring URLs, and pages viewed.
  • Crash and Performance Data. Diagnostic data including crash logs and performance metrics to help us identify and fix issues with the Services.

1.3 Information from Third-Party Sources

We may receive information from third-party sources, including:

  • ELD and Telematics Platforms. When you connect the Services to a third-party electronic logging device (ELD) or fleet management platform (such as GeoTab, Platform Science, Samsara, Trimble, or Motive), we may receive vehicle performance data, hours of service data, driver behavior data, and other telematics data from those platforms.
  • Map and Traffic Data Providers. We receive map data, traffic data, and road information from third-party providers including HERE Technologies to power navigation and routing features.
  • Authentication Providers. If you sign in using Google Sign-In, we receive basic profile information from Google as described in Section 1.1.

2. How We Use Your Information

Argus AI uses the information we collect for the following purposes:

  • Providing and Operating the Services. To deliver navigation, routing, turn-by-turn directions, real-time traffic alerts, and other core features of the Services.
  • Background Location Processing. To monitor route conditions and deliver proactive incident and traffic alerts even when the App is not in the foreground, enabling faster rerouting and timely notifications.
  • Account Management. To create and manage your account, process subscriptions and payments, and authenticate your identity.
  • Personalization and Improvement. To personalize your experience, improve the Services, develop new features, and optimize routing algorithms based on aggregated usage patterns.
  • Customer Support. To respond to your inquiries, provide technical support, and address issues with the Services.
  • Safety and Security. To detect, prevent, and respond to fraud, abuse, security incidents, and technical issues.
  • Communications. To send you service-related communications including account notifications, billing information, feature updates, and security alerts. With your consent where required, we may also send promotional communications.
  • Analytics. To analyze usage trends, measure the effectiveness of features, and generate aggregated and de-identified insights.
  • Legal Compliance. To comply with applicable laws, regulations, legal processes, and governmental requests, and to enforce our Terms of Service.

3. How We Share Your Information

Argus AI does not sell your personal information to third parties.

We may share your information in the following circumstances:

  • Service Providers. We share information with trusted third-party service providers who perform services on our behalf, such as cloud hosting, payment processing, analytics, and customer support. These providers are contractually obligated to use your information only to provide services to us and to maintain appropriate security measures.
  • Map and Navigation Data Providers. We share location and route data with our map data provider, HERE Technologies, as necessary to deliver navigation and routing services. HERE Technologies processes this data in accordance with its own privacy policy.
  • ELD and Telematics Integration Partners. When you connect the Services to a third-party ELD or fleet management platform, data is shared between the Services and that platform as necessary to provide integrated functionality. Your use of any integration partner's platform is governed by that partner's own privacy policy.
  • Fleet Administrators. If you access the Services through a fleet account, certain information including trip data, route history, and vehicle data may be visible to your fleet administrator.
  • Legal Requirements. We may disclose your information when required by law, court order, subpoena, or other legal process, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
  • Business Transfers. In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.
  • With Your Consent. We may share your information for other purposes with your express consent.

4. Third-Party SDKs and Services

The App integrates the following categories of third-party software development kits (SDKs) and services, which may collect and process data as described below:

  • HERE Technologies (Maps and Navigation SDK). Provides map data, routing, geocoding, and navigation services. HERE Technologies may collect location data, device information, and usage data in connection with providing these services. We will update this section as additional SDKs are integrated into the App. We ensure that all third-party SDKs used in the App comply with Google Play Developer Program policies, including restrictions on the sale of personal and sensitive user data.


5. Cookies and Tracking Technologies

When you access the Website (getargus.ai), we may use cookies, pixels, and similar tracking technologies to enhance your experience and gather analytics. These include:

  • Essential Cookies. Required for website functionality, such as maintaining login sessions.
  • Performance and Analytics Cookies. Used to understand how visitors interact with the Website and to improve performance.
  • Advertising Cookies. Used to deliver relevant advertisements and measure advertising campaign effectiveness.

You may adjust your browser settings to block or delete cookies. Please note that blocking cookies may limit certain Website functionalities. The App does not use browser cookies, but may use similar device-based identifiers for analytics purposes as described in Section 1.2.


6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Services. Specific retention periods include:

  • Account Information. Retained for the duration of your account and for up to 12 months after account deletion, except as required for legal, security, or fraud prevention purposes.
  • Location and Trip Data. Retained in identifiable form for up to 12 months for service delivery and improvement purposes. Location data may be retained in aggregated, de-identified form indefinitely for analytics and product improvement.
  • Payment Records. Retained for the period required by applicable tax and financial record-keeping laws.
  • Communications and Support Records. Retained for up to 24 months after the last communication.
  • Crash and Diagnostic Data. Retained for up to 12 months.

After the applicable retention period, personal information is either deleted or de-identified. We may retain certain information for longer periods when required by law, to resolve disputes, or to enforce our agreements.


7. Account Deletion

If you have created an account with Argus AI, you may request deletion of your account and associated personal data at any time through the following methods:

Upon receiving and verifying your deletion request, we will delete your account and associated personal data within 30 days, except for data we are required or permitted to retain for legitimate purposes such as legal compliance, fraud prevention, security, or financial record-keeping. We will inform you if any data is retained and the reason for retention.

Please note that account deletion is permanent and cannot be reversed. Temporary account deactivation or suspension does not constitute account deletion.


8. Data Security

We implement industry-standard technical and organizational security measures to protect your information from unauthorized access, loss, misuse, alteration, and destruction. These measures include:

  • Encryption. Data transmitted between your device and our servers is encrypted using HTTPS/TLS protocols.
  • Access Controls. Access to personal information is restricted to authorized personnel who require it to perform their job functions.
  • Secure Infrastructure. We use secure cloud hosting environments with firewall protection, intrusion detection, and regular security audits.
  • Authentication Security. We support secure authentication methods and encourage users to use strong, unique passwords.

Despite our efforts, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security of your information. You are responsible for maintaining the confidentiality of your account credentials and for any activity conducted through your account.


9. Your Rights and Choices

Depending on your location and applicable law, you may have the following rights regarding your personal information:

  • Access. Request a copy of the personal information we hold about you.
  • Correction. Request correction of inaccurate or incomplete personal information.
  • Deletion. Request deletion of your personal information, subject to legal and operational requirements (see Section 7).
  • Portability. Request a copy of your data in a structured, commonly used, and machine-readable format.
  • Opt-Out of Marketing. Opt out of promotional emails by using the "unsubscribe" link in any promotional email or by contacting us. Service-related communications are not subject to opt-out.
  • Location Permissions. You may control the App's access to your location through your device's operating system settings. Disabling location access will impair or prevent core functionality of the Services.
  • Push Notifications. You may control push notification preferences through your device settings or within the App.
  • Do Not Track. The Website respects browser Do Not Track (DNT) signals where technically feasible. Third-party services integrated with the Website may not respond to DNT signals.

9.1 California Residents

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and its amendments, including the right to know what personal information we collect and how it is used, the right to request deletion, and the right to opt out of the sale of personal information. 9.2 European Economic Area, United Kingdom, and Switzerland Residents

If you are located in the EEA, UK, or Switzerland, we process your personal data on the following legal bases: performance of our contract with you (to provide the Services), your consent (for optional data processing such as marketing), our legitimate interests (for analytics, security, and service improvement), and compliance with legal obligations. You may have additional rights under the General Data Protection Regulation (GDPR) or equivalent local laws, including the right to lodge a complaint with your local data protection authority.


10. Children's Privacy

The Services are not directed to children under the age of 13 (or the applicable age of consent in your jurisdiction). We do not knowingly collect personal information from children. If we learn that we have collected personal information from a child without appropriate consent, we will take steps to delete that information promptly. 11. Redistribution and Third-Party Use Restrictions

Argus AI strictly prohibits the unauthorized redistribution of its data, video feeds, and content. No content from the Services may be rebroadcasted, embedded, or resold without prior written consent. Unauthorized use may result in account termination and legal action.


13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, the Services, or applicable laws. We will notify you of material changes by posting the updated policy within the App and on the Website, and where required, by providing additional notice through email or in-app notification.

The "Last Updated" date at the top of this policy indicates when the most recent changes were made. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Privacy Policy.
